Número Ley 3436

Número Ley 3436.-Ley concede a la "Compañía Telefónica de larga distancia De Filipinas" una franquicia para instalar, operar y mantener un sistema de telefonía a través de las Islas Filipinas.

Que sea promulgado por el Senado y la Cámara de Representantes de las Filipinas en Legislatura montado y por la autoridad de la misma:

SECCIÓN 1. Sin perjuicio de las condiciones establecidas en la presente Ley y las disposiciones de la Ley Número Treinta y ciento ocho, en su versión modificada, no presente, se concede a la "Compañía Telefónica de larga distancia De Filipinas", sus sucesores o cesionarios, por un período de cincuenta años después de la aprobación de esta Ley, el derecho, el privilegio y la autoridad para construir, mantener y operar sistemas de telefonía que cubren las rutas más viables siguientes: Manila-Baguio, incluyendo todas las provincias atravesadas; Manila-Iloilo-Negros-Cebú, incluyendo las provincias e islas atravesada. En la inteligencia de que el concesionario está autorizada a construir, operar y mantener dichas líneas tributarias sucursal en las provincias atravesadas para conectar con las líneas principales, como el interés general puede justificar. El concesionario está autorizado para llevar a cabo el negocio de la transmisión eléctrica de mensajes, imágenes y señales en y entre las provincias y los municipios respectivos, y con el propósito de operar dichos sistemas telefónicos y de transmisión de impresiones, mensajes, imágenes y señales por medio de electricidad, para la construcción de líneas telefónicas en y entre dicho provincias y municipios y para sentar, lugar, operar y mantener los cables telefónicos entre las Islas Filipinas y otros países, y para construir, mantener y operar y utilizar todos los aparatos, conductos, y aparatos necesarios para la transmisión eléctrica de impresiones, mensajes, imágenes y señales, y para erigir postes, estructuras, cables de cuerda, construir conductos, tendido de cables, y para construir, mantener y utilizar otros medios aceptados aprobados y en general de la conducción eléctrica en , encima de, sobre o debajo de las vías públicas, Gobierno derecho de vía, tierras, puentes, ríos, aguas, calles, carriles y aceras de dichas provincias y municipios, y los gastos generales o líneas subterráneas o en la superficie de la tierra y de tender cables telefónicos submarinos en las aguas circundantes de las Islas Filipinas y con el propósito de hacer la conexión con los sistemas telefónicos de otros países, como puede ser necesario y mejor adaptado a dicha transmisión: Disponiéndose, sin embargo, que todos los cables tendidos, todo postes levantados y todos los conductos construidos o utilizados por el concesionario, sus sucesores o cesionarios, deberán situarse en los lugares designados por el Secretario de Comercio y Comunicaciones y postes deben ser montados de manera profesional a satisfacción de dicho oficial: y disponiéndose, además , que, previa notificación razonable de la Secretaría de Comercio y Comunicaciones del concesionario, sus sucesores o cesionarios pueden ser obligados a trasladar los postes o eliminar o aumentar los cables u otros conductores con el fin de permitir el paso de los edificios u otras estructuras de un lugar a otro, la mitad del coste real de dicha reubicación de postes o crianza o eliminación de cables u otros conductores a pagar por la persona a cuya instancia se ha desplazado el edificio o estructura; y, a expensas del concesionario, sus sucesores o cesionarios, para reubicar conductos, postes y cables y para levantar o quitar los cables u otros conductores cuando el Secretario de Comercio y Comunicaciones así lo ordene y cuando el interés público así lo requiere: Disponiéndose, por último, que de cualquier orden para reubicar conductos, postes, o alambres, o para aumentar o quitar cables u otros conductores, dicho concesionario, sus sucesores o cesionarios, tendrá derecho a recurrir ante el Gobernador general, cuya decisión en el cuestión será definitiva.

En caso de que el concesionario, sus sucesores o cesionarios, fallar, basura, o negligencia en el plazo de diez días después de la notificación de trasladar sus postes, conductos, cables u otros conductores, o para elevar sus cables u otros conductores cuando así se lo indique el Secretario de Comercio y Comunicaciones entonces este oficial puede reubicar dicho postes, conductos, cables u otros conductores o aumento dichos alambres u otros conductores a expensas del concesionario, sus sucesores o cesionarios: Siempre que la instalación de todos los instrumentos, el cableado interno y todo trabajo de construcción exterior deberá hacerse de acuerdo con las normas y reglamentos, prescrito por el Secretario de Comercio y Comunicaciones: se proporcionan, además, que cada vez veinticinco o más pares de cables u otros conductores se realizan en una sola línea de polos en cualquier ciudad o centro municipal, dichos alambres o conductores deberán estar colocados en un cable y que cada vez más de ochocientos pares de cables u otros conductores se realizan en una línea de postes, dichos cables se colocarán bajo tierra por el concesionario, sus sucesores o cesionarios , siempre que ordenan de manera que hacer por el Secretario de Comercio y Comunicaciones: se proporcionan, además, que los postes erigidos, alambres y cables colgados, o conductos establecidos en virtud de esta franquicia se dispondrán de forma que no se perjudique la transmisión eficiente y eficaz de mensajes o señales por cualquier otra empresa cuyos polos se erigen, cuyos alambres y cables se encadenan, o cuyos conductos están realmente establecido en el momento en que los polos se van a montar, alambres y cables son a ser suspendidos o conductos que se quieran establecer en virtud y en virtud de esta franquicia: y siempre, por último, que los postes erigidos por el concesionario deberán ser de una altura tal que mantenga los alambres estirados en la misma a una altura de por lo menos diez pies por encima del nivel del terreno para proporcionar una altura de al menos quince pies en carreteras o calles de cruce, y se colocará a fin de no ser un peligro para la seguridad pública, de acuerdo con un plan aprobado por el Secretario de Comercio y Comunicaciones.

Sección 5. El concesionario podrá instalar, mantener y operar equipos de radio-teléfono que proporcione un medio económico de las comunicaciones telefónicas en las rutas mencionadas en la sección primera de esta Ley y entre las islas Filipinas, embarcaciones y sistemas telefónicos de otros países: Siempre , que la ubicación, instalación u operación de cualquier radiotelegrafía o imagen equipos deben ser aprobados previamente por el Gobernador general por recomendación de la Secretaría de Comercio y Comunicaciones: y disponiéndose, además, que el Secretario de Comercio y Comunicaciones, sujeto a la aprobación del Gobernador general, tendrá autoridad para supervisar y regular la instalación o el funcionamiento de tales radiotelegrafía o la imagen del equipo. Este privilegio de instalar, mantener y operar radiotelegrafía o equipo de imagen no se interpretará para autorizar la transmisión de cualquier mensaje comercial, o la transmisión de cualquier alquiler facsímil mensaje tor por el equipo radiográfico o la transmisión de mensajes de radio-telegráfica de alquiler .

Sección 3. El concesionario deberá suministrar el servicio telefónico en cualquier municipio cubierta por las vías mencionadas en la sección uno donde puede haber establecido una central telefónica local a cualquier solicitante de la misma, dentro de los treinta días siguientes a la fecha de su aplicación, y entre tal solicitante y otros como los solicitantes, en el orden de la fecha de su solicitud, hasta el límite de la capacidad de la red telefónica de dicho concesionario, que será determinado por la Comisión de Administración Pública en la aplicación de dicho concesionario, y si la demanda para el servicio telefónico en todo momento aumentar más allá de la capacidad del sistema de telefonía local de dicho concesionario para suministrar el mismo, la capacidad de dicho sistema telefónico se incrementará en dicho concesionario para satisfacer dicha demanda, de conformidad con la decisión de la Comisión de Administración Pública o su sucesor legal: Disponiéndose, que en caso de que el punto en el que el servicio telefónico se va a suministrar, es más de cincuenta metros de las líneas centrales locales operados por dicho concesionario, éste no estarán obligados a proporcionar dicho servicio, a menos que el solicitante para el servicio telefónico sufraga los gastos reales de los postes y cables y la instalación de los mismos necesarios para tal servicio, y en tales casos, la Comisión de Administración Pública podrá ampliar el plazo en que el concesionario obligado a suministrar los servicios más allá de ese plazo de treinta días

Sección 4. A los efectos de montaje y mantenimiento de postes u otros soportes para dichos cables u otros conductores o con el propósito de la puesta y el mantenimiento de dicho subterránea alambres, cables u otros conductores, será legal para el concesionario, sus sucesores o cesionarios , con la aprobación previa del Secretario de Comercio y Comunicaciones, para realizar excavaciones o la puesta conductos en cualquiera de los lugares públicos, carreteras, calles, caminos, calles, avenidas, aceras, o puentes de dichas provincias: condición, sin embargo, que cualquier lugar público, carretera, calle, carril, callejón, avenida, acera o un puente perturbados, alterado o cambiado a causa de la erección de postes u otros soportes, o el metro tendido de cables u otros conductores o de los conductos deberá ser reparado y reemplazado de manera profesional por dicho concesionario, sus sucesores o cesionarios, a satisfacción de la Secretaría de Comercio y Comunicaciones. En caso de que el concesionario, sus sucesores o cesionarios, después de los diez días de aviso por parte de dicha autoridad, fallar, basura, o negligencia para reparar o reemplazar cualquier parte de un lugar público, camino, carretera, calle, carril, callejón, avenida, acera o puente altere, cambie o perturbada por dicho concesionario, sus sucesores o cesionarios, a continuación, el Secretario de Comercio y Comunicaciones, tienen el derecho a tener el mismo reparado y se coloca en buen estado y condición en el costo y los gastos del concesionario, su sucesores o cesionarios.

Sección 5. Todas las líneas telefónicas y sistemas para la transmisión de mensajes y señales de propiedad, mantenimiento, u operados por el concesionario, sus sucesores o cesionarios, será operado y mantenido en todo momento de manera satisfactoria, y será deber más de dicho concesionario, sus sucesores o cesionarios, siempre que sea requerido para ello por la Comisión de Administración Pública, para modificar, mejorar y cambiar tal sistema telefónico o sistemas, para la transmisión de mensajes y señales por medio de la electricidad, en la forma y en medida como el progreso de la ciencia y las mejoras en el método de transmisión de mensajes y señales por medio de la electricidad puede hacer razonable y adecuada.

Sección 6. El concesionario, sus sucesores o cesionarios, deberá mantener una cuenta separada de los ingresos brutos de la empresa telefónica y la transmisión eléctrica por ésta en cada uno de los municipios de las diferentes provincias y presentará al Auditor Insular y el Tesorero Insular una copia de dicha cuenta, a más tardar el día treinta y uno de julio de cada año durante los doce meses anteriores al primer día del mes de julio.

Sección 7. El concesionario, sus sucesores o cesionarios, será responsable de pagar los mismos impuestos sobre sus bienes inmuebles, edificios, y la propiedad personal, exclusivo de esta franquicia, ya que otras personas o corporaciones son ahora o en el futuro puede ser requerido por la ley para paga. Además, el concesionario, sus sucesores o cesionarios, pagará al Tesorero Insular cada año, dentro de los diez días después de la auditoría y la aprobación de las hormigas como se prescribe en el apartado sexto de la franquicia, uno por ciento de todos los ingresos brutos del teléfono u otro negocio de transmisión eléctrica ejercidos en esta franquicia por el concesionario, sus sucesores o cesionarios, y dicho porcentaje será en lugar de todos los impuestos sobre esta franquicia o las ganancias de los mismos.

Sección 8. El concesionario no podrá iniciar cualquier construcción que sea de conformidad con esta franquicia sin antes obtener un Certificado de Necesidad y Conveniencia Pública de la Comisión de Administración Pública, de la forma y el carácter previsto en la Ley Número Treinta y ciento ocho, en su versión modificada , una autorización específica, dicha construcción. El concesionario no podrá ejercer ningún derecho o privilegio bajo esta franquicia sin antes haber obtenido el Certificado de Necesidad y Conveniencia Pública de la Comisión de Servicio Público. La Comisión de Servicio Público tendrá la facultad de emitir el Certificado de Necesidad y conveniencia pública siempre que deberá, previa audiencia, determinar que dicha construcción, o el ejercicio de dicho derecho, privilegio o franquicia, es necesario y adecuado para la conveniencia pública, y la Comisión tendrá la facultad, en la que se aprueba para imponer las condiciones para la construcción, equipamiento, mantenimiento, servicio u operación como la conveniencia pública y los intereses pueden requerir razonable, y el que se indicará la fecha en que el concesionario que comiencen los trabajos de construcción y el período dentro del cual se completó la obra. Con el fin de acogerse a los derechos otorgados por dicho Certificado de Necesidad y conveniencia pública el concesionario deberá presentar a la Comisión de Administración Pública, en el plazo que dicha Comisión fijará, por escrito su aceptación de los términos y condiciones de dicho certificado, junto con el documento que acredite el hecho de que el depósito requerido por dicho certificado se ha hecho. En el caso de que el concesionario no podrá iniciar el suministro del servicio telefónico se hace referencia en el certificado obtenida y archivada ser que se disponga en el plazo que la Comisión de Administración Pública tendrá fija, dicha Comisión podrá declarar dicho certificado nulo y el depósito hecho de conformidad con la sección nueve de esta ley decomisado por el Gobierno Insular a menos que se haya impedido que el concesionario de hacerlo por fuerza mayor, fuerza mayor, usurpada o el poder militar, estado de guerra, disturbios, insurrección, u otra causa fuera de su control: se suministra , sin embargo, que, si el donatario haya sido tan impedido por uno, varios o todos de tales causas de comenzar a suministrar el servicio telefónico dentro del plazo establecido, el tiempo durante el cual haya sido tan impedido se añade a dicho período.

Sección 9. El concesionario estará obligado por la Comisión de Servicio Público para cada Certificado de Necesidad y Conveniencia Pública obtenido por ella, para que en el plazo que la Comisión fijará dicho, un depósito de no menos de mil pesos, moneda filipina, o bonos negociables de los Estados Unidos, u otros valores aprobados por la Comisión de Administración Pública, del valor nominal de no menos de mil pesos, moneda filipina, en el Tesoro Insular como una garantía de buena fe que el concesionario, en el plazo también especificado por la Comisión de Administración Pública, deberá comenzar y terminar el trabajo necesario y estará provisto de todo el equipo necesario para iniciar el suministro de servicio telefónico en la provincia correspondiente, o provincias. La Comisión de Servicio Público ordenará la devolución del depósito de este medio necesario para el concesionario a la terminación de la obra para el suministro de servicios de telefonía de acuerdo con los términos y condiciones del certificado obtenidos, y el Tesorero Insular deberá devolver dicho depósito inmediatamente después presentación a él de una copia certificada de la orden de la Comisión de Servicio público.

Sección 10. Dentro de cuarenta días después de la aprobación de esta Ley, el concesionario deberá presentar ante el Secretario de Comercio y Comunicaciones de su aceptación por escrito de esta franquicia y de todos los términos y condiciones del presente documento, y en defecto de dicha aceptación, dentro del plazo así limitado, esta franquicia será considerada nula y sin efecto.

Artículo 11. Dentro de los seis meses después de la aprobación de esta Ley, el concesionario deberá presentar solicitud ante la Comisión de Servicio Público para un Certificado de Necesidad y conveniencia pública que le autoriza a construir, operar y mantener una línea telefónica de larga distancia entre las ciudades de Manila y Baguio. Seis meses después de la emisión de dicho certificado por la Comisión de Servicio Público, el concesionario deberá comenzar la construcción de la línea, y se iniciará la transmisión de mensajes dentro de doce meses desde la fecha de la emisión de dicho certificado de necesidad y conveniencia pública, salvo impedimento por caso fortuito, calamidad pública o cualquier circunstancias imprevistas que escapan al control del concesionario. El concesionario deberá construir las diferentes líneas telefónicas de larga distancia en el orden en el que se declaren en la sección primera de esta Ley, y si el concesionario no cumple con las condiciones establecidas en cualquiera de los certificados mencionados en el apartado octavo de esta Ley, a continuación, esta franquicia será considerada nula y sin valor a la línea telefónica de larga distancia concreto regulado por el certificado no tan cumplió con el concesionario o puede estar sujeto a una multa que no exceda de cinco mil pesos, según el criterio de la Comisión antes mencionada.

Sección 12. Como garantía de que esta franquicia ha sido aceptado de buena fe y que dentro de los doce meses desde la fecha de la concesión, por la Comisión de Administración Pública, de un Certificado de Necesidad y Conveniencia Pública que autoriza la construcción y explotación por el concesionario de un sistema de telefonía de larga distancia entre las ciudades de Manila y Baguio, y se extenderá además sus otras líneas telefónicas de larga distancia tan rápidamente como las condiciones lo justifican, a juicio del concesionario, el citado concesionario deberá depositar, dentro de los diez días siguientes a la concesión de tales Certificado de Necesidad y conveniencia pública, con el Tesorero Insular, la suma de veinticinco mil pesos, o bonos negociables de los Estados Unidos u otros valores, aprobado por el Secretario de Comercio y Comunicaciones, del valor nominal de veinticinco miles de pesos: Disponiéndose, que si el depósito se hace en dinero de la misma se depositarán en el interés en algún banco de interés que pagan aprobado por el Secretario de Comercio y Comunicaciones, y todo lo que causa interés y vencimiento en dicho depósito serán los obtenidos por la Insular Tesorero y pagados al concesionario, sus sucesores o cesionarios, a la carta: y siempre, además, que si el depósito realizado con el Tesorero Insular ya se trate de obligaciones negociables de los Estados Unidos u otros valores que devengan intereses aprobados por el Secretario de Comercio y Comunicaciones , el interés de dichos bonos o valores será percibida por el Tesorero Insular y pagó más al concesionario, sus sucesores o cesionarios, bajo demanda.

En caso de que dicho concesionario, sus sucesores o cesionarios, por cualquier otra causa que el acto de Dios, el enemigo público, usurpada o el poder militar, estado de guerra, disturbios, conmoción civil, o la causa inevitable, fallar, basura, o negligencia para empezar, dentro de los doce meses siguientes a la fecha de la concesión de dicho Certificado de Necesidad y conveniencia pública, el negocio de la transmisión de mensajes por teléfono, o no, basura, o negligencia que ser totalmente equipado y listo para operar, dentro de los doce meses siguientes a la fecha de la concesión de dicho Certificado de Necesidad y conveniencia pública, un sistema de telefonía de larga distancia entre las ciudades de Manila y Baguio acuerdo con los términos de esta franquicia, entonces el depósito prescrito por esta sección para hacerse con el Tesorero Insular, ya sea en dinero, bonos , u otros valores, pasarán a ser propiedad del Gobierno Insular en concepto de daños y perjuicios causados ​​a dicho Gobierno por dicho incumplimiento, la negativa o negligencia, y después de eso no hay intereses de dichos bonos u otros valores depositados se pagará al concesionario, sus sucesores o asigna, en caso de que dicho concesionario, sus sucesores o cesionarios, comience el negocio de la transmisión de mensajes por teléfono y estar listo para operar de acuerdo con los términos de esta franquicia de un sistema de telefonía de larga distancia entre las ciudades de Manila y Baguio dentro de los doce meses a partir de la fecha de la concesión de dicho certificado de necesidad y conveniencia pública, a continuación, y en ese caso el depósito establecido en la presente sección deberá ser devuelto por el Gobierno insular al concesionario, sus sucesores o cesionarios, por recomendación de la Comisión de Servicio público, tan pronto como el sistema telefónico entre las ciudades de Manila y Baguio se ha instalado de acuerdo con los términos de esta franquicia: Disponiéndose, además, que todo el tiempo durante el cual los sucesores de los concesionarios o cesionarios, pueden ser impedidos de llevar a cabo los términos y condiciones de esta franquicia por cualquiera de las causas, se añade el tiempo permitido por esta franquicia para el cumplimiento de sus disposiciones.

Sección 13. Los libros y las cuentas del concesionario, sus sucesores, cesionarios o, siempre estará abierta a la inspección de los auditores del distrito o sus representantes autorizados, y será deber del concesionario a presentar los informes trimestrales Insular Auditor por duplicado que demuestre los ingresos brutos y los ingresos netos para el trimestre pasado y el estado general de la empresa.

Artículo 14. Los derechos concedidos en este documento no será exclusiva, y los derechos y el poder de conceder a cualquier empresa, asociación o persona distinta de la franquicia de concesionario para el teléfono o la transmisión eléctrica de mensajes o señales no deberá resultar afectado o afectada por la concesión de esta franquicia: Siempre que los postes erigidos, alambres ensartados o cables o conductos establecidos en virtud de una franquicia por teléfono, u otra transmisión eléctrica de mensajes y señales otorgados con posterioridad a esta franquicia se dispondrán de forma que no se perjudique la eficiencia y la transmisión eficaz de mensajes o señales bajo esta franquicia por medio de postes erigidos, alambres ensartados o cables o conductos colocó efectivamente y en existencia en el momento de la concesión de dicha franquicia posterior: y proporciona, además, que la Comisión de Administración Pública, después de escuchar a ambas partes interesadas, pueden obligar al concesionario de esta franquicia, sus sucesores o cesionarios, para retirar, reubicar, o reemplazar sus postes, cables o conductos; pero en tal caso el costo razonable de la remoción, reubicación o sustitución deberá ser pagado por el concesionario de la franquicia subsiguiente o sus sucesores o cesionarios al concesionario de esta franquicia, sus sucesores o cesionarios.

Sección 15. El concesionario, sus sucesores o cesionarios, llevará a cabo la insular, provincial, la ciudad y los gobiernos municipales indemne de todo reclamo, cuentas, demandas o acciones derivadas de accidentes o lesiones, ya sea a los bienes o personas, causados ​​por la construcción u operación del teléfono u otro sistema de transmisión eléctrica de dicho concesionario, sus sucesores o cesionarios.

Sección 16. Las tarifas para el servicio de telefonía, tarifas planas, así como tasas medidas están sujetas a la aprobación de la Comisión de Administración Pública.

Las tarifas mensuales para los teléfonos que tienen un circuito metálico dentro de los límites de la Población del municipio también deberán ser aprobados por la Comisión de Administración Pública.

Artículo 17. El concesionario no podrá, sin la autorización previa y expresa del Congreso de Filipinas, directa o indirectamente, transferir, vender o asignar esta franquicia a cualquier persona, asociación, empresa o corporación u otra mercantil o entidad legal.

Artículo 18. El concesionario puede instalar, mantener, operar, compra o arrendamiento de tales estaciones, líneas telefónicas, cables o sistema como es, o son, conveniente o esencial para llevar a cabo de manera eficiente el propósito de esta franquicia: Disponiéndose, sin embargo, que el concesionario , sus sucesores o cesionarios no podrá, sin el permiso de la Comisión de Servicio público primera tenido, instalar, mantener, operar, la compra o arrendamiento de tales estaciones, líneas, cables o sistemas.

Sección 19. El Gobierno de Filipinas tendrá el privilegio, sin compensación, de la utilización de los polos del concesionario para adjuntar una cruceta de bolos, y de instalar, mantener y operar los cables de su sistema de telégrafo al respecto: Disponiéndose, sin embargo, que la Oficina del puesto de trabajo podrá tener el derecho de colocar crucetas y cables adicionales en los polos del concesionario mediante el pago de una compensación, la tasa de los cuales ha de ser acordada por el director de Correos y el concesionario: Disponiéndose, además, que en caso de desacuerdo en cuanto a tasa de contrato de alquiler, el mismo será fijado por la Comisión de Administración Pública. Los municipios también tendrán el privilegio, sin compensación, de la utilización de los polos del concesionario, para fijar un brazo cruzado estándar, y de instalar, mantener y operar los cables de la policía local y el sistema de alarma contra incendios; pero los cables de tales líneas de telégrafo, la policía o el sistema de alarma contra incendios se colocan y se encadenan en la forma de no causar interferencia o daños a los cables o el servicio de teléfono del concesionario.

Artículo 20. El concesionario, sus sucesores o cesionarios no podrán emitir acciones o bonos bajo esta licencia salvo a cambio de dinero o de bienes a un precio justo igual al valor nominal de las acciones o bonos así emitidos.

Sección 21. Esta franquicia se concede con el entendimiento y con la condición de que estará sujeta a modificación, alteración o derogación por el Congreso de los Estados Unidos conforme a lo dispuesto en el apartado veintiocho de la Ley del Congreso de agosto vigésimo noveno mil novecientos dieciséis, titulada "Ley para declarar el fin de la población de los Estados Unidos en cuanto a la futura condición política de los habitantes de las Islas Filipinas, y para proporcionar un gobierno más autónomo para esas islas", y que se estarán sujetos, en todos los aspectos, a las limitaciones sobre las empresas y la concesión de franquicias contenida en dicha Ley del Congreso, y que todas las tierras o derechos de uso o la ocupación de las tierras aseguradas en virtud de esta franquicia serán devueltas a su terminación a la gobiernos insular, provincial o municipal, que eran los dueños de la misma en la fecha de concesión de esta franquicia.

Las disposiciones anteriores y todos los demás términos y disposiciones de la sección setenta y cuatro de la Ley del Congreso de primero de Julio de mil novecientos dos, aplicable al concesionario de franquicias o concesiones o sus sucesores o cesionarios, se incorporan en y forman parte del al efecto, con el mismo efecto como si estuvieran contenidas en el mismo.

Artículo 22. Los municipios por los que se van a construir las líneas de larga distancia del concesionario, operado y mantenido, no será necesaria para conectar sus teléfonos con las líneas telefónicas de larga distancia antes mencionados del concesionario sin la aprobación del consejo municipal o junta provincial preocupa.

Sección 23. Esta franquicia no se interpretará como que autoriza al concesionario a participar en el negocio de enviar o recibir mensajes de radio-telegráfica de alquiler.

Sección 24. Siempre que en esta franquicia se utiliza el término "concesionario", que se llevará a cabo y entiende y representan la "Compañía Telefónica de larga distancia De Filipinas," sus representantes, sucesores o cesionarios.

Artículo 25. Esta Ley entrará en vigor cuando haya sido aprobado.

Act No. 3436

Number 3436.—An Act granting to the “Philippine Long Distance Telephone Company” a franchise to install, operate, and maintain a telephone system throughout the Philippine Islands.

Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:

SECTION 1. Subject to the conditions established in this Act and the provisions of Act Numbered Thirty-one hundred and eight, as amended, there is hereby granted to the “Philippine Long Distance Telephone Company,” its successors or assigns, for a period of fifty years from the approval of this Act, the right, privilege, and authority to construct, maintain and operate telephone systems covering the most feasible following routes: Manila-Baguio, including all provinces traversed; Manila-Iloilo-Negros-Cebu, including the provinces and islands traversed. It being understood that the grantee is authorized to construct, operate and maintain such branch tributary lines within the provinces traversed to connect with the main lines, as the public interest may warrant. The grantee is authorized to carry on the business of the electrical transmission of messages, pictures, and signals in and between provinces and respective municipalities, and for the purpose of operating said telephone systems and transmitting impressions, messages, pictures, and signals by means of electricity, to construct telephone lines in and between said provinces and municipalities and to lay, place, operate, and maintain telephone cables between the Philippine Islands and other countries, and to construct, maintain, and operate and use all apparatus, conduits, and appliances necessary for the electrical transmission of impressions, messages, pictures, and signals, and to erect poles, structures, string wires, build conduits, lay cables, and to construct, maintain, and use such other approved and generally accepted means of electrical conduction in, on, over, or under the public roads, Government right-of-ways, lands, bridges, rivers, waters, streets, lanes, and sidewalks of said provinces and municipalities, and overhead or underground lines or on the surface of the ground, and to lay submarine telephone cables in the surrounding waters of the Philippine Islands and for the purpose of making connection with telephone systems of other countries, as may be necessary and best adapted to said transmission: Provided, however, That all cables laid, all poles erected and all conduits constructed or used by the grantee, its successors or assigns, shall be located in places designated by the Secretary of Commerce and Communications and poles shall be erected in a workmanlike manner to the satisfaction of said official: And provided, further, That upon reasonable notice of the Secretary of Commerce and Communications the grantee, its successors or assigns may be required to relocate poles or remove or raise wires or other conductors so as to permit the passage of buildings or other structures from one place to another, one-half the actual cost of such relocation of poles or raising or removal of wires or other conductors to be paid by the person at whose instance the building or structure is moved; and, at the expense of the grantee, its successors or assigns, to relocate conduits, poles, and wires and to raise or remove wires or other conductors when the Secretary of Commerce and Communications so orders and when the public interest so requires: Provided, finally, That from any order to relocate conduits, poles, or wires, or to raise or remove wires or other conductors, the said grantee, its successors or assigns, shall have the right of appeal to the Governor-General, whose decision in the matter shall be final.

Should the grantee, its successors or assigns, fail, refuse, or neglect within a period of ten days after notice to relocate its poles, conduits, wires, or other conductors, or to raise its wires or other conductors when so directed by the Secretary of Commerce and Communications then this official may relocate said poles, conduits, wires, or other conductors or raise said wires or other conductors at the expense of the grantee, its successors or assigns: Provided, That the installation of all instruments, inside wiring and all outside construction work shall be done in accordance with the rules and regulations, prescribed by the Secretary of Commerce and Communications: Provided, further, That whenever twenty-five or more pairs of wires or other conductors are carried on one line of poles in any city or municipal center, said wires or conductors shall be placed in one cable and that whenever more than eight hundred pairs of wires or other conductors are carried on one line of poles, said cables shall be placed underground by the grantee, its successors or assigns, whenever ordered so to do by the Secretary of Commerce and Communications: Provided, further, That the poles erected, wires and cables strung, or conduits laid by virtue of this franchise shall be so placed as not to impair the efficient and effective transmission of messages or signals by any other company whose poles are erected, whose wires and cables are strung, or whose conduits are actually laid at the time that poles are to be erected, wires and cables are to be strung, or conduits are to be laid under and by virtue of this franchise: And provided, finally, That the poles erected by the grantee shall be of such a height as to maintain the wires stretched on the same at a height of at least ten feet above the level of the ground providing a height of at least fifteen feet in crossing roads or streets, and shall be placed so as not to be a danger to the public safety, in accordance with a plan approved by the Secretary of Commerce and Communications.

SECtion 5. The grantee may install, maintain, and operate radio-telephone equipment to furnish an economical medium of telephonic communications in the routes mentioned in section one of this Act and between the Philippine Islands, vessels, and telephone systems of other countries: Provided, That the location, installation or operation of any such radio-telephonic or picture equipment must be previously approved by the Governor-General upon recommendation of the Secretary of Commerce and Communications: And provided, further, That the Secretary of Commerce and Communications, subject to the approval of the Governor-General, shall have authority to supervise and regulate the installation or operation of such radio-telephonic or picture equipment. This privilege to install, maintain, and operate radio-telephonic or picture equipment shall not be construed to authorize the broadcasting of any commercial message, or the transmission of any facsimile message tor hire by radiographic equipment or the transmission of radio-telegraphic messages for hire.

SECtion 3. The grantee shall supply telephone service in any municipality covered by the routes mentioned in section one where it may have established a local telephone exchange to any applicant for the same, within thirty days after the date of their application, and as between such applicant and other like applicants, in the order of the date of their applications, up to the limit of the capacity of the telephone system of said grantee, to be determined by the Public Service Commission on the application of said grantee, and should the demand for telephone service at any time increase beyond the capacity of the local telephone system of said grantee to supply the same, the capacity of said telephone system shall be increased by said grantee to meet such demand, in accordance with decision of the Public Service Commission or its legal successor: Provided, That in case the point at which the telephone service is to be supplied, is more than fifty meters from the local exchange lines operated by said grantee, the latter shall not be obliged to furnish said service, unless the applicant for telephone service defrays the actual expenses for the poles and wires and installation thereof necessary for such service and in such cases the Public Service Commission may extend the time within which the grantee must furnish such service beyond the said period of thirty days

SECtion 4. For the purpose of erecting and maintaining poles or other supports for said wires or other conductors or for the purpose of laying and maintaining underground said wires, cables, or other conductors, it shall be lawful for the grantee, its successors or assigns, with the prior approval of the Secretary of Commerce and Communications, to make excavations or lay conduits in any of the public places, highways, streets, lanes, alleys, avenues, sidewalks, or bridges of said provinces: Provided, however, That any public place, highway, street, lane, alley, avenue, sidewalk or bridge disturbed, altered, or changed by reason of the erection of poles or other supports, or the laying underground of wires, or other conductors, or of conduits shall be repaired and replaced in a workmanlike manner by said grantee, its successors or assigns, to the satisfaction of the Secretary of Commerce and Communications. Should the grantee, its successors or assigns, after the ten days’ notice from said authority, fail, refuse, or neglect to repair or replace any part of a public place, road, highway, street, lane, alley, avenue, sidewalk or bridge altered, changed, or disturbed by said grantee, its successors or assigns, then the Secretary of Commerce and Communications, shall have the right to have the same repaired and placed in good order and condition at the cost and expense of the grantee, its successors or assigns.

SECtion 5. All telephone lines and systems for the transmission of messages and signals owned, maintained, or operated by the grantee, its successors or assigns, shall be operated and maintained at all times in a satisfactory manner, and it shall be the further duty of said grantee, its successors or assigns, whenever required to do so by the Public Service Commission, to modify, improve, and change such telephone system or systems, for the transmission of messages and signals by means of electricity, in such manner and to such extent as the progress of science and improvements in the method of transmission of messages and signals by means of electricity may make reasonable and proper.

SECtion 6. The grantee, its successors or assigns, shall keep a separate account of the gross receipts of the telephone and electrical transmission business transacted by it in each of the municipalities of the various provinces and shall furnish to the Insular Auditor and the Insular Treasurer a copy of such account not later than the thirty-first day of July of each year for the twelve months preceding the first day of July.

SECtion 7. The grantee, its successors or assigns, shall be liable to pay the same taxes on their real estate, buildings, and personal property, exclusive of this franchise, as other persons or corporations are now or hereafter may be required by law to pay. In addition, the grantee, its successors or assigns, shall pay to the Insular Treasurer each year, within ten days after the audit and approval of the ants as prescribed in section six of the franchise, one per centum of all gross receipts of the telephone or other electrical transmission business transacted under this franchise by the grantee, its successors or assigns, and the said percentage shall be in lieu of all taxes on this franchise or earnings thereof.

SECtion 8. The grantee shall not begin any construction whatever pursuant to this franchise without first obtaining a Certificate of Public Necessity and Convenience from the Public Service Commission, of the form and character provided for in Act Numbered Thirty-one hundred and eight, as amended, specifically authorizing such construction. The grantee shall not exercise any right or privilege under this franchise without first having obtained such Certificate of Public Necessity and Convenience from the Public Service Commission. The Public Service Commission shall have the power to issue such Certificate of Public Necessity and Convenience whenever it shall, after due hearing, determine that such construction, or such exercise of the right, privilege or franchise, is necessary and proper for the public convenience, and the Commission shall have the power in so approving to impose such conditions as to construction, equipment, maintenance, service or operation as the public convenience and interests may reasonably require, and such certificate shall state the date the grantee commences construction work and the period within which the work shall be completed. In order to avail itself of the rights granted by such Certificate of Public Necessity and Convenience the grantee must file with the Public Service Commission, within such period as said Commission shall fix, its acceptance in writing of the terms and conditions of said certificate, together with the document evidencing the fact that the deposit required by said certificate has been made. In the event that the grantee shall not commence the furnishing of telephone service referred to in the certificate obtained and filed as herein provided within such period as the Public Service Commission shall have fixed, said Commission may declare such certificate null and void and the deposit made pursuant to section nine of this Act forfeited to the Insular Government unless the grantee shall have been prevented from doing so by act of God, force majeure, usurped or military power, martial law, riot, uprising, or other cause beyond its control: Provided, however, That, if the grantee shall have been so prevented by one or more or all of such causes from commencing to furnish telephone service within the period specified, the time during which it shall have been so prevented shall be added to said period.

SECtion 9. The grantee shall be required by the Public Service Commission for each Certificate of Public Necessity and Convenience obtained by it, to make within such period as the said Commission shall fix, a deposit of not less than one thousand pesos, Philippine currency, or negotiable bonds of the United States, or other securities approved by the Public Service Commission, of the par value of not less than one thousand pesos, Philippine currency, in the Insular Treasury as a guaranty of good faith that the grantee, within the period also specified by the Public Service Commission, shall commence and terminate the necessary work and shall be provided with all the equipment necessary to commence furnishing telephone service in the corresponding province, or provinces. The Public Service Commission shall order the return of the deposit hereby required to the grantee upon the termination of the work for the furnishing of telephone service in accordance with the terms and conditions of the certificate obtained, and the Insular Treasurer shall return said deposit immediately upon presentation to him of a certified copy of the order of the Public Service Commission.

SECtion 10. Within forty days after the approval of this Act, the grantee shall file with the Secretary of Commerce and Communications its written acceptance of this franchise and of all the terms and conditions hereof, and in default of such acceptance, within the time so limited, this franchise shall become null and void.

SECtion 11. Within six months after the approval of this Act, the grantee shall file application with the Public Service Commission for a Certificate of Public Necessity and Convenience authorizing it to construct, operate, and maintain a long distance telephone line between the Cities of Manila and Baguio. Six months after the issuance of the said certificate by the Public Service Commission, the grantee shall commence the construction of the line, and shall begin transmitting messages within twelve months from the date of the issuance of said Certificate of Public Necessity and Convenience, unless prevented by act of God, public calamity or any unforeseen circumstances beyond the control of the grantee. The grantee shall construct the different long distance telephone lines in the order in which they are stated in section one of this Act, and should the grantee fail to comply with the conditions set forth in any of the certificates mentioned in section eight of this Act, then this franchise shall become null and void as to the particular long distance telephone line covered by certificate not so complied with or the grantee may be subject to a fine not exceeding five thousand pesos, at the discretion of the aforesaid Commission.

SECtion 12. As a guaranty that this franchise has been accepted in good faith and that within twelve months from the date of the granting, by the Public Service Commission, of a Certificate of Public Necessity and Convenience authorizing the construction and operation by the grantee of a long distance telephone system between the Cities of Manila and Baguio, and shall furthermore extend its other long distance telephone lines as rapidly as conditions so warrant, in the judgment of the grantee, the said grantee shall deposit, within ten days of the granting of such Certificate of Public Necessity and Convenience, with the Insular Treasurer, the sum of twenty-five thousand pesos, or negotiable bonds of the United States or other securities, approved by the Secretary of Commerce and Communications, of the face value of twenty-five thousand pesos: Provided, That if the deposit is made in money the same shall be deposited at interest in some interest-paying bank approved by the Secretary of Commerce and Communications, and all interest accruing and due on such deposit shall be collected by the Insular Treasurer and paid to the grantee, its successors or assigns, on demand: And provided, further, That if the deposit made with the Insular Treasurer be it negotiable bonds of the United States or other interest bearing securities approved by the Secretary of Commerce and Communications, the interest on such bonds or securities shall be collected by the Insular Treasurer and paid over to the grantee, its successors or assigns, on demand.

Should the said grantee, its successors or assigns, for any other cause than the act of God, the public enemy, usurped or military power, martial law, riot, civil commotion, or inevitable cause, fail, refuse, or neglect to begin, within twelve months from the date of the granting of said Certificate of Public Necessity and Convenience, the business of transmitting messages by telephone, or fail, refuse, or neglect to be fully equipped and ready to operate, within twelve months from the date of the granting of said Certificate of Public Necessity and Convenience, a long distance telephone system between the Cities of Manila and Baguio according to the terms of this franchise, then the deposit prescribed by this section to be made with the Insular Treasurer, whether in money, bonds, or other securities, shall become the property of the Insular Government as liquidated damages caused to such Government by such failure, refusal, or neglect, and thereafter no interest on said bonds or other securities deposited shall be paid to the grantee, its successors or assigns, Should the said grantee, its successors or assigns, begin the business of transmitting messages by telephone and be ready to operate according to the terms of this franchise a long distance telephone system between the Cities of Manila and Baguio within twelve months from the date of the granting of said Certificate of Public Necessity and Convenience, then and in that event the deposit prescribed by this section shall be returned by the insular Government to the grantee, its successors, or assigns, upon recommendation of the Public Service Commission, as soon as the telephone system between the Cities of Manila and Baguio has been installed in accordance with the terms of this franchise: Provided, further, That all the time during which the grantee successors or assigns, may be prevented from carrying out the terms and conditions of this franchise by any of causes shall be added to the time allowed by this franchise for compliance with its provisions.

SECtion 13. The books and accounts of the grantee, its successors, or assigns, shall always be open to the inspection of the district auditors or his authorized representatives, and it shall be the duty of the grantee to submit to the Insular Auditor quarterly reports in duplicate showing the gross receipts and the net receipts for the quarter past and the general condition of the business.

SECtion 14. The rights herein granted shall not be exclusive, and the rights and power to grant to any corporation, association, or person other than the grantee franchise for the telephone or electrical transmission of messages or signals shall not be impaired or affected by the granting of this franchise: Provided, That the poles erected, wires strung or cables or conduits laid by virtue of any franchise for telephone, or other electrical transmission of messages and signals granted subsequent to this franchise shall be so placed as not to impair the efficient and effective transmission of messages or signals under this franchise by means of poles erected, wires strung, or cables or conduits actually laid and in existence at the time of the granting of said subsequent franchise: And provided, further, That the Public Service Commission, after hearing both parties interested, may compel the grantee of this franchise or its successors or assigns, to remove, relocate, or replace its poles, wires or conduits; but in such case the reasonable cost of the removal, relocation, or replacement shall be paid by the grantee of the subsequent franchise or his successors or assigns to the grantee of this franchise or its successors or assigns.

SECtion 15. The grantee, its successors or assigns, shall hold the Insular, provincial, city and municipal governments harmless from all claims, accounts, demands, or actions arising out of accidents or injuries, whether to property or to persons, caused by the construction or operation of the telephone or other electrical transmission system of the said grantee, its successors or assigns.

SECtion 16. The rates for the telephone service, flat rates as well as measured rates are subject to the approval of the Public Service Commission.

The monthly rates for telephones having a metallic circuit within the limits of the población of the municipality shall also be approved by the Public Service Commission.

SECtion 17. The grantee shall not, without the previous and explicit approval of the Philippine Legislature, directly or indirectly, transfer, sell, or assign this franchise to any person, association, company, or corporation or other mercantile or legal entity.

SECtion 18. The grantee may install, maintain, operate, purchase or lease such telephone stations, lines, cables or system as is, or are, convenient or essential to efficiently carry out the purpose of this franchise: Provided, however, That the grantee, its successors or assigns shall not, without the permission of the Public Service Commission first had, install, maintain, operate, purchase or lease such stations, lines, cables or systems.

SECtion 19. The Philippine Government shall have the privilege, without compensation, of using the poles of the grantee to attach one ten-pin crossarm, and to install, maintain and operate wires of its telegraph system thereon: Provided, however, That the Bureau of Posts shall have the right to place additional crossarms and wires on the poles of the grantee by paying a compensation, the rate of which is to be agreed upon by the Director of Posts and the grantee: Provided, further, That in case of disagreement as to rate of contract rental, same shall be fixed by the Public Service Commission. Municipalities shall also have the privilege, without compensation, of using the poles of the grantee, to attach one standard crossarm, and to install, maintain and operate wires of a local police and fire alarm system; but the wires of such telegraph lines, police or fire alarm system shall be placed and strung in such manner as to cause no interference with or damage to the wires or the telephone service of the grantee.

SECtion  20. The grantee, its successors or assigns shall not issue stock or bonds under this franchise except in exchange for actual cash or property at a fair valuation equal to the par value of the stock or bonds so issued.

SECtion  21. This franchise is granted with the understanding and upon the condition that it shall be subject to amendment, alteration, or repeal by the Congress of the United States as provided in section twenty-eight of the Act of Congress approved August twenty-ninth, nineteen hundred and sixteen, entitled “An Act to declare the purpose of the people of the United States as to the future political status of the people of the Philippine Islands, and to provide a more autonomous government for those Islands,” and that it shall be subject, in all respects, to the limitations upon corporations and the granting of franchises contained in said Act of Congress, and that all lands or rights of use or occupation of lands secured by virtue of this franchise shall revert upon its termination to the Insular, provincial, or municipal governments which were the owners thereof upon the date on which this franchise was granted.

The foregoing provisions and all other terms and provisions of section seventy-four of the Act of Congress approved July first, nineteen hundred and two, applicable to the grantee of franchises or concessions or their successors or assigns, are hereby incorporated in and made part of these presents, with the same effect as If they were expressed herein.

SECtion 22. The municipalities through which the long distance lines of the grantee are to be constructed, operated, and maintained, shall not be required to connect their telephones with the aforesaid long distance telephone lines of the grantee without the approval of the municipal council or provincial board concerned.

SECtion  23. This franchise shall not be construed as authorizing the grantee to engage in the business of sending or receiving radio-telegraphic messages for hire.

SECtion 24. Wherever in this franchise the term “grantee” is used, it shall be held and understood to mean and represent the “Philippine Long Distance Telephone Company,” its representatives, successors or assigns.

SECtion 25. This Act shall take effect on its approval.

TV Patrol's revamp because of new administration and congressional franchise renewal

In time for President-elect [[Rodrigo Duterte|Rody Duterte]]'s inauguration, on June 30, 2016, it retained the original debut title (TV Patrol) with a same logo (still using the RGB ABS-CBN colors, this time with radar-type design in the 2013 logo and the round-shape globe in the 2001 logo), new opening titles (featuring the TV Patrol logos of the past and the present). Noli de Castro, Bernadette Sembrano and Ted Failon as weeknight anchors of TV Patrol, while Alvin Elchico and Zen Hernandez as anchors for the weekend edition. The studio design, which is used for the ABS-CBN's election coverage last May 9 and 10 that will accommodate augmented reality technology alongside Bandila and theme music was introduced which incorporates the Filipino composition of Allegro, with elements of the "Allegro" orchestra version and combines the elements of the original 1996-2001 version and "Pulstar" in the 2010-2016 theme, the 1992-1996 ABS-CBN News and Public Affairs Theme and the ABS-CBN's jingle and it also added the rock guitar version, as well as TV Patrol World's 2004 and 2006 theme music.

By December 13, 2016, it will close to 13 Regions, 81 provinces, 1,489 municipalities, 145 Cities and 42,029 barangays.

ABS-CBN's new logo in preparation for digital TV broadcasts.


In 2013, ABS-CBN announced that they were going to use a new logo as part of its 60th anniversary of Philippine Television. The new logo, which maintains the 2000 design, gives thicker width to the three rings and the line, and a simplified version of the 2000 text of ABS-CBN's name which removes the serifs, and a completely different version of the C which replaces the 2000-style C letter, with the S letter being the only one unchanged. The square also changed its color to white (this was done most likely to reflect ABS-CBN's status as a diversified media company more significantly), leading to the square's absence whenever the logo is placed on white backgrounds. The logo was unveiled on 7 October 2013 and was officially launched on 1 January 2014, 14 years after the 2000 logo was launched.

Today, the tri-band radio transmission waves graphic element and the original typography are used in derivatives as logos and logotypes of subsidiaries of the ABS-CBN Corporation.

Laos, the only country in the Southeast Asian Region, with 17 provinces and capital Vientiane.
